GENERAL TERMS AND CONDITIONS OF CONTRACT

These General Conditions regulate the contracting of tourist services mediated by Könux Travel (hereinafter, "the Agency"), who acts as an intermediary between passengers and the various providers of tourist services.

Contracting any service implies full acceptance of these conditions.


1. Nature of the Agency

The Agency acts exclusively as an intermediary in the marketing and contracting of tourist services provided by third parties, such as:

Excursions.

Transfers.

Navigations.

Inbound services.

Travel insurance.

Any other contracted tourist service.

The actual performance of these services is the sole responsibility of each provider.


2. Applications, reservations and payments

Reservations will be subject to provider availability.

Amounts paid before final confirmation will be considered a reservation.

The contract will only be finalized when the Agency confirms the availability of the service and issues the corresponding documentation (voucher, ticket, service order or equivalent receipt).

Prices may be subject to change until final confirmation when available.

tariff modifications by suppliers;

exchange rate variations;

tax increases;

new government rates;

causes beyond the Agency's control.

Once the service has been confirmed and paid for in full, the price will remain unchanged, except for mandatory modifications resulting from taxes or fees established by the competent authority.

Failure to pay within the agreed deadlines will entitle the Agency to cancel the reservation, applying the corresponding penalties according to the supplier's terms and conditions.


3. Included Services

Each booking will only include the services expressly detailed in the voucher or confirmation issued by the Agency.

Any service not expressly included may be considered contracted.


4. Services not included

Unless otherwise stated, prices do not include:

airport or port taxes;

entrances to National Parks;

municipal taxes;

tourist taxes;

visas;

medical assistance for travelers;

unspecified food and beverages;

tips;

personal expenses;

special equipment;

optional services;

Insurance not included;

any other service not expressly detailed.


5. Cancellations by the passenger

All cancellations must be requested in writing.

Refunds will be subject to the specific conditions of each service provider.

When a refund is due, the Agency may deduct:

administrative expenses;

bank charges;

payment platform fees;

non-refundable amounts collected by providers.

When the supplier establishes its own penalties, they will be mandatory for the passenger.

In case of non-show ("No Show"), no refund will be given unless expressly provided by the supplier.


6. Modifications and date changes

Any date change will be subject to supplier availability.

The Agency does not guarantee the possibility of rescheduling services.

The changes may result in tariff differences and administrative costs, which will be communicated in advance.


7. Cancellations due to weather conditions or force majeure

Activities may be modified, suspended, or cancelled due to:

meteorological conditions;

provisions of competent authorities;

security reasons;

Force Majeure;

unforeseen event;

labor disputes;

emergencies;

operational restrictions.

When possible, a rescheduling will be offered.

If that is not possible, refunds will be made in accordance with the policies of the responsible provider.

If the activity has already started and needs to be modified for safety reasons, a full refund of the service will not necessarily be due.


8. Documentation

It is the passenger's sole responsibility to have all the documentation required to carry out the trip or contracted activity.

The Agency will not be responsible for:

expired documentation;

damaged documentation;

visas;

immigration permits;

authorizations for minors;

health certificates;

any requirement demanded by national or foreign authorities.

The inability to travel due to non-compliance with these requirements will be considered a cancellation attributable to the passenger.


9. Health status

The passenger declares that they are in adequate physical condition to perform the contracted activity.

You must also inform us in advance of any:

disease;

disability;

pregnancy;

allergy;

medical treatment;

physical limitation;

special dietary needs.

The omission of such information exempts the Agency from liability for the resulting consequences.


10. Passenger conduct

The passenger must respect the instructions given by guides, drivers, captains, security personnel and others responsible for the service.

The Agency and/or the provider may prevent participation or order the exclusion of the passenger when the passenger:

is under the influence of alcohol or drugs;

maintain aggressive behavior;

put your safety or the safety of others at risk;

violates safety regulations.

In such cases, no refund will be given.


11. Responsibility

The Agency acts exclusively as an intermediary.

Responsibility for the effective provision of services lies solely with the provider who performs them.

The Agency will not be responsible for:

cancellations;

delays;

modifications;

accidents;

loss or damage to luggage;

breaches attributable to third parties;

climatic phenomena;

decisions of public authorities;

strikes;

road closures;

operational restrictions;

events of force majeure.

This is without prejudice to any rights that the passenger may have against the responsible provider under current legislation.


12. Claims

All claims must be made in writing within fifteen (15) calendar days after the completion of the service, accompanied by the relevant supporting documentation.

The Agency will handle the claim with the provider when appropriate.


13. Protection of personal data

The personal data provided will be processed in accordance with Law No. 25.326 on the Protection of Personal Data.

They will be used solely for reservation management, document issuance, invoicing, and compliance with legal obligations.


14. Right of withdrawal

When applicable under current Argentine legislation for contracts concluded remotely, the passenger may exercise the right of revocation within the legal period.

This right will not affect services whose execution has already begun or whose delivery date reasonably prevents its exercise, in accordance with the exceptions provided for by the applicable regulations.


15. Applicable legislation

These General Conditions shall be governed by the Argentine regulations in force in the jurisdiction of the province of Tierra del Fuego, Antarctica and the South Atlantic Islands. 


16. Jurisdiction

Any dispute arising from these General Conditions will be submitted to the competent courts that correspond according to the applicable Argentine legislation, without prejudice to the rights that the consumer protection regulations recognize to the passenger.


17. Acceptance

Contracting, making full or partial payment for services, accepting the invoice or voucher, or using any of the contracted services will imply full acceptance of these General Conditions.
